Timeline Of Negotiations

2010

On 14 June 2010 the Government announced that it would be repealing the 2004 Act, including the Crown declaration of ownership in section 13, and replacing it with legislation broadly in line with the proposals in the consultation document.  In addition, the Government announced that the replacement legislation will provide for the recognition of the enduring mana of iwi in respect of their foreshore and seabed (something already contained in the Ngati Porou Deed), ownership of non-nationalised minerals would be included in customary title and confirmation that those iwi with Treaty settlements would not be excluded from negotiations or litigation to obtain recognition of their customary interests.
The timeframes in the Deed have previously been extended in order to have the opportunity to assess the government’s proposals for replacement legislation.  This was because any replacement legislation may have implications for the Deed.  The availability of customary title, a more balanced test for customary title (than the test for Territorial Customary Rights under the 2004 Act), and the removal of the requirement for High Court confirmation of the negotiated agreement are among the positive changes under the replacement legislation.  Amendments to the Deed and the legislation to give effect to the Deed will be considered in order to incorporate the replacement legislation.
Regardless of any legislative changes, preparation for implementation of the Deed is ongoing and the Foreshore and Seabed Committee are continuing this background work, including meeting and working with whanau and hapu.
On April 30th submissions closed on the Review of the Foreshore and Seabed Act 2004
On the 14th April public consultation hui were held at Muriwai Marae and the Emerald Hotel, in attendance were the Attorney General and other members of the Committee.
In March the Government released the consultation document Reviewing the Foreshore and Seabed Act 2004.
In March the Crown and representatives of ngâ hapű o Ngâti Porou agreed to further extend the timeframe for filing the High Court applications and the Management Arrangements to 30 March 2011.

2009

On 2 February, the Crown and representatives of ngâ hapű o Ngâti Porou agreed to extend the timeframe for filing the High Court application to 30 April 2009.
On 30 April, the Crown and representatives of ngâ hapű o Ngâti Porou agreed to extend the timeframe for filing the High Court application to 30 September 2009.
In May the Runanga appointed a Foreshore and Seabed Committee FSC with oversight of the implementation of the Deed.
In September, the Crown and representatives of ngâ hapű o Ngâti Porou agreed to further extend the timeframe for filing the High Court application to 30 March 2010.

The Foreshore and Seabed Committee held an initial round of  hui with nga hapu o Ngati Porou to prepare for implementation of the Foreshore and Seabed Deed of Agreement

These  hui also focused  on the legal instruments contained in the Deed and legal entity options for hapu to consider.

 February - Heads of Agreement was officially signed at Parliament, the Runanga consulted with TCR hapu from June – August when the Deed of Agreement to be ratified was signed by Dr Michael Cullen (Attorney General) and Dr Apirana Mahuika

2007

A series of rohe hui were held in April to discuss the collection of traditional evidence, the development of a draft deed of agreement and the legal mechanisms through which hapu rights will be recognised.

Collection of traditional evidence and negotiations resulted in the following areas being chosen as TCR test case areas.

1. Matakaoa
2. North west of Horoera
3. Pakihi to the northern side of Waiapu River
4. Southern side of Waiapu River to Te Wharau
5. Whareponga
6. Marau Beach
7. Paerau Point

2006


The negotiations continued in 2006 the main work being the collection of customary evidence that told the Ngati Porou story. Researchers were appointed in 2006-2007 tasked with gathering Ngati Porou customary evidence.  These researchers were Rei Kohere, Elizabeth Ngarimu, Jock Walker, John-Ray Paenga.

Under the FSSB Act 2004 the test to prove customary title or Territorial Customary Rights TCR is very difficult. Our position was that hapu claim an unbroken chain of ownership from original settlement to today in accordance with tikanga, statute, and common law. That the rights to the takutaimoana are held and exercised by hapu as a collective right. That Ngati Porou hapu do not seek the right to sell the foreshore / seabed or ignore environmental standards

Evidence was gathered based on the model below, the Crown must be satisfied that enough evidence was collected that supports the test in the Act to acknowledge that hapu are TCR areas.


2005

Te Runanga o Ngati Porou Foreshore & Seabed Consultation Hui

In September 2005 a Statement of Position document was signed which was a place holder in the event a Don Brash led National Government came into power. At the end of 2005 and the beginning of 2006 the Runanga undertook a mandating exercise to ask nga hapu o Ngati Porou if they supported the Runanga role as facilitator of the negotiations.

As a consequence approximately 40 hapu agreed with the direction of the negotiations and 11 hapu choose not to support or to be outside of negotiations. The statement of position can be viewed here Click to Download Reader

The negotiating team presented a Statement of Position and  asked  hapu to consider the document and provide feedback.

In addition these hui sought  an indication from hapu regarding the level of support for the continuation of negotiations and the continued facilitation role of Te Runanga o Ngati Porou in these negotiations.

2004

During this time Te Whanau a Apanui joined the negotiations and the negotiations became a joint process from then on.
The Runanga appointed negotiators were Dr Apirana Mahuika and lawyer Matanuku Mahuika working on behalf of nga hapu o Ngati Porou.
Consultation with Ngati Porou continued in 2004, outcomes for a negotiations were designed and taken around Ngati Porou whanui. 

A 4 hour documentary was prepared for television show Waka Huia.

On 1 November 2004 the Crown and the Runanga on behalf of nga hapu o Ngati Porou from Potikirua to Te Toka a Taiau entered into a Terms of Agreement Click to Download Reader setting out the scope, objectives and procedures for the negotiations.

It was while the Runanga was consulting with Ngati Porou whanui that the FSSB Act was passed on the 24 November 2004.  And our position changed from trying to preserve our position to trying to get back what was lost as a result of the Act.

2003

The Ngati Apa Case & Ors v Attorney General – In 2003 the Court of Appeal ruled that the Maori Land Court had jurisdiction to entertain applications for customary title to land below the mean high water mark.
The Runanga supported applications by hapu to the Maori Land Court to have the FSSB in the Ngati Porou rohe declared Maori customary land.
The Government announces its FSSB policy which they took around New Zealand through a series of hui a iwi.  After discussions with Ngati Porou at home, in late 2003 the Runanga commenced negotiations on behalf o nga hapu o Ngati Porou with the Crown to protect the ownership interests of nga hapu o Ngati Porou.
